Terms of Service
These Terms govern your use of the Exitember Discord bot and related materials (including self-hosted instances of the MIT-licensed software). Contact: exitember@zoitra.com.
1. Agreement
By inviting Exitember to a Discord server, using its commands, responding to a leave survey, or running the software yourself, you agree to these Terms and the Privacy Policy. If you do not agree, do not use Exitember.
2. Software license
The Exitember source code is provided under the MIT License (see the repository
LICENSE file). That license covers the software; these Terms cover use of
the operator-run bot service and expectations when interacting with it.
3. The service (as-is)
Exitember is provided as is and as available, without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. The operator may modify, suspend, or discontinue the hosted bot at any time without liability.
4. Discord rules
You must comply with Discord’s Terms of Service, Community Guidelines, and Developer Terms. Exitember is not affiliated with or endorsed by Discord Inc.
5. Acceptable use
- Do not abuse, reverse-engineer for harmful purposes, or overload the bot
- Do not use Exitember to harass, spam, or collect data beyond the leave survey purpose
- Do not attempt to access other guilds’ data or circumvent security controls
- Only configure the bot in servers where you have authority to do so
6. Server setup requirements
Configuring the staff log channel with /setup requires the Discord
Manage Server permission (or equivalent). You are responsible for
choosing an appropriate channel and for who can read survey summaries there.
7. Leave surveys and DM delivery
Exitember attempts to DM departing members a short survey. Delivery often fails because of Discord privacy settings (for example, blocking DMs from server members). Failed DMs are not a breach of these Terms; leaves may still be logged for staff. Survey responses are voluntary.
8. Self-hosting
If you run your own instance, you are responsible for securing tokens, database credentials, compliance with Discord’s rules, and your own privacy notices to users of your instance.
9. Limitation of liability
To the maximum extent permitted by law, Team Zoitra / Exitember shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising from use of or inability to use Exitember, whether based in contract, tort, or otherwise, even if advised of the possibility. Total liability for any claim relating to the service shall not exceed US $0 for free use of the operator-run bot, or the amount you paid the operator for the service in the twelve months before the claim (if any).
10. Indemnity
You agree to indemnify and hold harmless the operator from claims arising out of your misuse of Exitember, your server’s configuration, or your violation of these Terms or Discord’s rules.
11. Governing law
These Terms are governed by the laws of the United States and the state or jurisdiction of the operator’s residence, without regard to conflict-of-law principles. Courts in that jurisdiction shall have exclusive venue, except where prohibited by law. (Placeholder: US. Refine with counsel if needed.)
12. Changes
We may update these Terms. The “Last updated” date will change when we do. Continued use after an update constitutes acceptance where permitted by law.
